F1 requires a intent of non-immigration. By filing I-140 you already showed intent to immigrate (labor approval alone will not be considered intent to immigrate). You will not be able to get COS to F1 from H1B. Even if USCIS grants your COS by mistake you will have hard-time getting a VISA at an American Embassy.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

My original L1B visa was from Mar2004 to Mar2009 ( 5 years)
In Aug 2008 I left my L1 sponsor and started working on EAD for different employer( used AC21 portability)
Now my question is can my employer apply for H1B visa for me in April 2010?

I am new to this thread. I have a bachelor degree in Applied Science in IT and got it in about 1 and half years because I got an points exemption from my advance diploma. I also have 7 years of IT working experience and currently hold a H1B1 visa. H1B1 and H1B are not the same thing. The question is can I apply for my GC in eb2 category?

Can I file AC21 to change my employer to Company B and continue my I485 through to Company B?

If my priority date is current as of November bulletin, do I have time
until 30th November to mail the I-485 application?
Or does the DOS need to have received the application on or before 30th November?
And if I am in California, where does the I-485 application physically go?
[Its a long story why I didn't when the doors were open in July-Aug]

The first step is to be eligible for mortgage.
During an interview with mortgage counsellor, she asked my visa status.
I tried explaining her that I was not on H1 and had not received GC yet, that I am on EAD.
But she did not understand it. She only understands H1 or GreenCard.
I am not on H1 since I changed my employer and it expires this October.
I have also travelled on Advanced parole.
Recent EAD is good until 2010.
Can anyone help?

We are future permanent residents waiting in queue, for sure many of us are going to get GCs in few weeks/months/years. Considering this situation lawmakers can give us a chance to get the GC faster than waiting in the queue just by buying a house. But still they are searching for another solution than which could be effective.
