Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
In McDonald v. Chicago, The Supreme Court reasserted today that individuals have the right to retain guns at both the State and Local levels. The Majority consisting of conservative justices---- Alito, Roberts, Scalia, Thomas, and Kennedy based their decision on the history of the second Amendment, where militias were given the right to protect their farmlands. At that time we had no organized police force, we had no justice system in place.
Who are the militias of today? The KKK-- the uneducated people, who generally do not work, collect welfare checks, and blame all their owes on the colored people and now the "illegal immigrants."
If the Supreme Court grants the right to local levels to enact gun controls, one can only speculate for instance what kind of gun control laws Maricopa COunty in Arizona will enact.
Due Process protects every "individual"; it does not say "citizens". And just like every individual has the right to protect themselves with weapons, every individuals also have the more fundamental right to live.
Although the justices said that the Second Amendment allows for a reasonable restriction of guns, their rationale based on history of the second Amendment gives the militias a carte blanche right to bear arms. This can indeed set a dangerous precedence.

Hi
I am going to appear for H1-B interview next month.
I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
Is that a real big problem?
Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.
Please help.

We asked for people to come forward to transcribe the calls. We do not have anyone. I am sure a lot of people waiting for EADs for their spouses will be having well qualified spouses who can volunteer their time. We have lawyers available to be on calls, but people do not even send questions on time when we announce. We organize calls on weekends, and only few people show up. However we get thousands to show up on tracker threads everyday.
We are doing this as a free service to the community. If people do not value it and help us, they can get their own own lawyers and get paid consultation.
We will not be posting recording for people who do not even want to give us a minute and complete their profile so that we can contact them. The service may also be discontinued if members do not see any value in it.

My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

My spouse currently is in H4. Is it possible to get his F1 visa stamped (with i-20 and other documents) within US? for example, in local USCIS offices.?
Also, does getting COS (h4 to f1) approved means, we can exit and enter US without stamping in INDIA?

AFAIK, EB1-B requirement includes at least a tenure-track position with the sponsoring University, whereas from your current job title I would guess yours is a contractual (no-tenure-track) position. You may instead take a shot at EB1-A (exceptional ability), which, like EB2-NIW, does not require a tenure-track job. Also, from your stated qualifications, you have a reasonable chance of getting approved, more so if a competent attorney handles your case. (I should add, these days USCIS seems to have raised the bar of EB1-A approval relative to EB2-NIW, so hiring a good attorney is important.)

You are a better sponsor coz they can reject the visa saying potential immigrant if ur uncle sponsors it and its easier as many parents visit are coming.

Unless you know the outcome, you never know.
Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.
my employer has no clue whether it can be done or not. however i posted this same Q to my attorney. i am waiting for the response from him. If anyone else have any inputs, i would appreciate it.

Hello,
I am planning to file H1 petition through a sponsor . I am having questions for h1 duration and initial h1 approval time, here is my details :
I am on L1 right now and my L1 stay in US is :
Apr'07 - Dec'07 - 9 months
Jan'08 - Mar'09 - Was in india
Mar'09 - till date - ~13 months.
Now my questions are :
1) If I apply for h1, how much time I can stay on h1 considering L1 stay as well ?
2) How much time initially h1 could be approved before doing h1 extension for another 3 years ?

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

Hi,
My U.S. born son is travelling with my friends from India to USA. He had gone to India for summer vacation. Would anybody have any sample letter for addressing to immigration authorities that we authorize his travel along with my friend.
Thanks.
US born child is citizen by birth and has RIGHT to enter United States. Immigration officials cant deny him the right to enter USA.
A simple letter saying that you have authorised your friend to accompany your child (minor) for the travel. The letter should have your contact address, cell etc

Till today No FP
Finally today Mar 18 I got a mail saying
Application Type: I140 , IMMIGRANT PETITION FOR ALIEN WORKER
Current Status: Case Transfered to Another Office for Processing
So now on what basis date, RD Aug 22 or transfer date Mar 18 they will touch my case .How long will it take ? Any body on same boat.....

Just carrying a copy of the receipt is sufficient. Normally the officer will only be interested in the passport and original AP document - that was my experience recently coming into the country.

I recently noticed the Audited Dates for PERM moved up nearly by 9 months to Dec 2009.
My labor filed in June 2009 has been in audit.
My employer is telling that that still my case is in process.
Has any body filed in 2009 and been in Audit got it approved recently?
Those of you who have audited PERMS should check with the employers as the employers may not be checking the status regularly. Please do post if you have any updates.
