I was employed by company A between 2002 who has filed I-140 and I-485 in 2007.
After company ceased to exist, USCIS granted an H1 extension based on an approved ALC filing and I moved to company B. According to the owner of company A, it has no plans to file for bankruptcy.
Company B filed for the H1B extension and I received one that expires Oct 2012. However, company B is now unwilling to continue my employment. My employment will cease Nov 2010.
Besides looking for another job, anyone has any inputs?

I got hold of a copy of the actual RFE and when I read closely, the above statement sounded alarming. Since the labor was filed in 2003, I was wondering what relevance June 26, 2006 has.
Any help is appreciated.

i was trying to understand how many visas are available for recapture.

from this report it seems like all the visa numbers are being used already atleast for years 2007-2009
i am assuming there were some visas lost before 2007. does anyone has any links justifying that.

You must be actually in H-1B status in order to use the H-1B portability provisions. This is what allows you to start with Company B once their H-1B petition is filed, rather than wait until the petition is approved. To use this, you need to get into H-1B status for Company A 9either through a COS petition or by entering the US in H-1B status. I don't recommend that latter option if you know that you will be changing employers as soon as you enter the US.
Alternatively, you could change from Co. A L-1 to Co. B H-1B, but you cannot start working for Co. B till the COS is approved.

Hi
My H1b was approved in feb 2010 for location A.Before I could start working at location A,my company found a better client (close to home,better pay) at location B .(different state).
what should my company do or have done with regards to lca for me to work at location b.
should lca have been approved before I moved to location b or could it be filed after i started working at location b. If lca was filed after I started working, is that ok.If not, how do we correct this.

My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? I changed jobs twice after I-140 approval/180 - days of filing 485. I am in the 6th year of my H-1B. Both the times I transfered my H-1B and got validity for 3 years based on AC-21.
Now I know there is no formal form for AC-21. Most of the people send a letter along with some supporting documentation that their new job is similar to the old one. I didn't send any such letter, however when my H-1B transfers were done, the attorneys quoted AC-21 in the petition and got 3 year H-1B extensions.
My question is, would that consider notifying USCIS of AC-21, or is the 485 department different from H-1B department?

My company want to be neutral. They don't want me to join in the plaintiff. Best would be AILA talking to the company and asking their help.
