Here is my situation and below are my question...
Entry to US - 08/14/2005
Petiton is valid till 06/17/2011 (and I have vacation time of 4 weeks).
Labor applied on EB2 category on 09/23/2010
EB2 labor Audit replied in June 2009.
H1B extension based on pending labor applied on 12/03/2010.
EB2 labor denied on -12/13/2010.
Question??
What will happen to my H1B extension? and what time it will get extended?or what action should we take?
Do I need to re-appeal the labor that has been denied ,apply for H1B extension and wait to get clear the 7th year extension (thruogh premium? from June 2011 to June 2012).
Can I apply for EB2 or EB3?(which would be best in my scenario, I think i still have time if 7th year H1B extension is approved).
Can we apply EB2 even after we appeal previous labor which is also on EB2 category ? or do we have to withdraw old EB2 labor and then re-apply again on EB2?
Please help me with the above questions and I really appreciate your help in this regard.

Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).
Also, please can you specify the USCIS rule under which it is applicable?

You can file H1-B extension based on your approved i-140 you should receive another 3 yrs extension i did the same.
Did you file this H1-B extension after changing employer using AC21? Is it approved for 3 years?

In case of a job loss what are my options? By that I mean what kind of jobs should I look for on AC21. Also, can you switch multiple employers on AC21.
Pl advise.

Actually forgot to mention that two weeks back there was LUD's on my and my spouse case. But so far no LUD on my kid's case. So I doubt my kid's application has seperated from ours.
Any other comments, guys?
BTW, taking an info pass, is it mandatory that our dates should be current?

My EAD expired in late April
Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).
I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.
If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?
How do employers handle something like this?

Hi,
Currently I am in US in H1B and my I-94 is expires in Sept 30 2010 and there is an extension filed for my H1.
In the mean time I want to file I-130 and I-485 based on my brothers citizenship.
Whether the status will change before sept 30 2010? Also if I leave US whether the application will be still valid and how much time it takes to get an approval for both?

Folks, here are some lobbying and action items that will be very useful.
1) Try reaching out to your American friends/managers/colleagues and ask them to call Senators.
2) Universities are missing in action here. They are major beneficiaries of high-skilled immigration, because graduate school is typical first step. They must be concerned with not only the fact that special categories for researchers/professors is gone but also that lot fewer students from India and China will labor in their labs. COUNCIL OF GRADUATE EDUCATION is a good place to start.
3) Someone please write and op-ed piece of NY Times. They are pretty sympathetic to these kind of issues. A major criteria for publication in the op-ed section is that the topic should be current. The plight of legal immigrants can't get more current that this. Any op-ed piece will get major exposure to our plight. Here is a link on how to contribute to NYT op-ed: http://www.nytimes.com/ref/membercenter/help/opedsubmit.html
The op-ed should not be complaining in tone, but rather show the value of having a proper high-skilled immigration reform for the American economy.

If not EB1, even EB2 is fine because you belong to UK and EB2 is current for you. If you claim EB1, you can easily apply in EB2 and it's "current" for you.

applied June 27th( NSC ), still no FP..
Called them yesterday..the lady said that we need to wait for a 102 more days before they can consider this an issue :eek:
basically, there is no time period for FP , if we dont get EAD in the time frame then we call and ask. That's what the lady suggested.

Hello,
I have been a GC holder for the past two years. I obtained the GC through employment but lost my job 3 months ago.
I am planning to leave Boston, spend a month in Canada and relocate in CA when I return to the USA. I will be driving out of the US to Canada during the first week of May 2010, spending a month in Canada and then coming to California early June 2010 by plane with my LPR status.
I will use the on-line change of address tool before traveling to Canada to let the USCIS know of my new permanent address in California. I already have a place to live in California.
My questions are:
1) Should I expect to go through some problems at the airport when going through the custom?
2) Will they ask me if I am employed?
3) Should I let the USCIS know of my new permanent address just 10 days before I go to California, or earlier?
Any advice?

I and the lawyer studio failed the first request for a VISA. I didn't like their way to work and all the money they asked ( 12000 USD for nothing) so I am looking for alternatives.
Is it my right to have back FOR FREE all the documentation they have collected ?

If someone is going to be filing for I-140 on a recently approved EB2 (India) while on H1-B in USA with same employer, is it better to check the first box (Alien will apply for visa at a consulate abroad - meaning consular processing of 485) instead of AOS? My understanding is once I-140 is approved and if 485 dates become current, then if CP has been indicated on I-140, then the consulate abroad will order visa number in the month after and the person should get an interview call, even if the dates retrogress back in the following months?
In that case indicating CP is better than AOS on I-140? If so, can the person continue to work on H-1 while waiting for the interview call at consulate abroad?
Thoughts appreciated. Anyone please?
