I got my 45 day letter last month. The letter came to the Lawyer's office who faxed it to HR. HR director signed it and returned it to the lawyer who then posted it back to BEC. I looked at a copy of this letter. It is very straight forward. It only requires the attention of employer and/or lawyer. The employee does not figure into it at all. So, follow up with employer (HR) and your lawyer about it. But do not delay. If BEC does not receive a response within 45 days they will mercilessly close the case. So, beware!

Mmm.. here is a wrinkle scenario.. though it does not technically belong here...
I was overseas for a year (posted to another branch of the company, in another country, not my country of origin, for a year), just returned to US.
Would I be considered as "in US" all the time? And would I be considered to be "in US" for the time I was posted abroad?
The reason I'm asking is that given the way this is going with this legislation if if goes through, it might be better to be an "illegal" rather than legal. I see Zero talk about people in our situation (legal nomads).
Let us get to the bottom line.. is this legislation strategically really good for us? Is a "sneak" legislation better for us than a blanket amnesty which equates an illegal hedge pruner to a legal high skilled worker and makes no distinction?
Does it make more sense for us to have this legislation scuttled than face the prospect of seeing your friendly neighbourhood illegal plumber get on the gravy train while you wait and wait? (People like me would be waiting anyway even without this legislation)
I would really appreciate a strategic FAQ: What are we really fighting for here.. what are the likely compromises on the way..

Hello All:
We got our FP done yesterday at the Atlanta ASC and thought I would share the experience and procedures incase anyone was interested or looking for this info.
Received FP notice on 3/5/08 for FP appointment on 3/19/08 11:00am at 1255 Collier Road, Atlanta, GA 30318.
We reached the ASC on time. At the door the security guard checks the FP notice and verifies your identity with either a Passport, GC or DL. We only showed our DL and it was fine. NO BAGS and NO CELLPHONES allowed. Was asked to leave my wife's bag in the car. Also, they will not allow ANYONE except the person with appointment in the office. I saw spouses who didnt have appointment waiting outside.
You then go into the office (which is basically a BIG room) with seats and fingerprint stations and the FP notice and ID was checked again and given a form to fill out. Simple form, nothing different. All the information needed on the form (A#, Receipt No.) is on your FP notice. You fill out the form, return it and get a ticket to wait in line. The receptionist also Stamped the FP Notice at this point. We saw approx 80 people all with the same appointment time.
When your number is called or shows up on the counter, they look at your documents again and took us to a FP station. FP Notice was scanned in and was asked to verify the spelling of my name and Address. Then they took FP of all 10 fingers, then again of Index Finger (both hands) and the again of both Thumbs. He saw the FP on the monitor and retook some of the FP again. After that, Picture was taken. The FP Technician then signed the FP notice on the stamp given earlier.
The entire process from before entering to exiting took about 1.5 hours. I would recommend you take a book or magazine to pass some time.
Sorry for the long post but just thought someone might be looking for this information. I am not aware if any of this information for the other centers.

I'm a Jul 2nd filer at NSC and got my receipts on Aug 12 with a notice date of Aug 8th.I'm yet to receive my FP notice.

Like Tom said, EAD is irrelevant to your studying on parolee status. The only thing is you cannot work during the EAD gap.

I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.

1. Question regarding my I-94 form...
I have one which I got when entered US, 4 yrs back which is expired and after that I got new ones with each H1B application extension.
Should I send all of them or just the latest one? or the one i got while entering (Expired one)

Hi, I have question about my case.
My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?
